Important HR AlertsHealth Care Reform Insurance Portal to be Established: On July 1, 2010, a website established under the Patient Protection and Affordable Care Act (PPACA) would help assist small businesses in identifying affordable health insurance coverage options in each state. FMLA Leave Rights Expanded: On June 22, 2010, the U.S. Department of Labor (DOL) clarified the "son or daughter" definition under the Family and Medical Leave Act (FMLA) regarding non-military leave. The new interpretation grants leave rights to an individual providing a child with daily care or financial support, regardless if a biological or legal relationship exists between the individual and the child. Grandfathered Health Care Plan Regulations Released: On June 17, 2010, the U.S. Departments of Health and Human Services (HHS), Labor, and Treasury issued interim final rules relating to "grandfathered" health care plans under the Patient Protection and Affordable Care Act (PPACA). Employer-provided health plans that existed as of March 23, 2010, are "grandfathered" and exempt from many of the law's consumer protections. The rules clarify that plans will lose their grandfather status if they choose to significantly cut benefits or increase out-of-pocket spending for consumers. E-Verify Program Interface Revamped: On June 13, 2010, the U.S. Citizenship and Immigration Services (USCIS) launched a redesigned E-Verify system, of which employers should plan additional time to take a required tutorial. Review of Employees' Text Messages Upheld: On June 17, 2010 , the Supreme Court found that City of Ontario did not violate its employees' Fourth Amendment right to be protected from unreasonable searches by reviewing the employees' text messages sent on pagers provided by the City. The Court noted that the City's search would also have been reasonable in the private workplace.

Question and Answer - Social Media Policy
Q. How does a manager best handle an employee that posts derogatory material on social networking (e.g. Facebook, LinkedIn, Twitter) sites about his / her supervisor? Is it the responsibility of the Company to react to something posted to a personal internet vehicle?A. The employer has some discretion in this area. While the U.S. provides for the right to expression, such legislation generally does not protect an employee’s job in the workplace. Employees posting negative information about the company or its employees, customers, vendors, etc. on a website may face disciplinary action.
While the employer is not required to monitor all of its employees’ social networking activities, it is the company’s prerogative whether to react to public postings that may be detrimental to the company’s reputation. We recommend that management review the remarks posted on the web. If considering the remarks as damaging to the company, management may approach the employee to discuss the situation and opt to take the disciplinary action that it deems appropriate, up to and including termination of employment.
As a side note, you as the employer may need to consider distributing an up-to-date Social Networking Policy in order to ensure all employees use precautions when utilizing social networking sites.
